Sexist and sexual harassment (SSH) in healthcare facilities

Abstract

The notions of harassment, whatever its form and nature, are already old notions that already appear officially in the Opinions and Reports of the Economic and Social Council in 2001, (which became the Economic, Social and Environmental Council in 2008). A Code of Good Conduct has been recommended by the EEC to member States, employers and trade unions aimed at preventing and prohibiting sexual harassment behaviour in the public and private sectors. (2001). The definitions of HSS are different in the Labour Code (L 6 August 2012 and L of 21 March 2022) and the Criminal Code (Article 222-33-2-2 Version 2018) Sexual harassment is characterised by the repeated imposition on a person of comments or behaviour with sexual or sexist connotations, which undermine their dignity due to their degrading or humiliating nature, or create an intimidating, hostile or offensive situation against him. Sexual harassment is any form of serious pressure (even if not repeated) with the real or apparent aim of obtaining a sexual act, for the benefit of the perpetrator or a third party. Sexual harassment is punishable by two years in prison and a fine of €30,000.
The surveys carried out by the NOC Doctors, the NOC Nurses and the young collegium of orthopaedic surgeons in 2024 show some very worrying results on SSH: SSH can have appalling consequences 65% of active doctors say they have been aware of SSH in the medical world and 29% of active doctors say they have been victims, mostly during their student career, but with a very high preponderance of women victims, 54% compared to 5% of men. Of these 54% of women victims of SSH, 49% of sexist and sexual insults, 18% of sexual harassment, 9% of sexual assault and 2% of rape. A significant proportion of this violence comes from doctors registered with the National Order: 26% of doctors say they have suffered SSH perpetrated by another doctor. Women are the most affected: 49% of active female doctors compared to 3% of men. For nurses, 49% report having experienced SSH at least once during their practice (53% women and 24% men). These violence are reflected in: inappropriate reflections due to their gender, (39%) of sexist outrages, (21%) sexual assaults (4%),rapes (0.13%)
Conclusion :It is essential that the ANC advocate zero tolerance for SSH and express its solidarity and support to the victims of HSS.
