Presentation of decree No. 2022 1765 of December 29, 2022 relating to the conditions for the implementation of surgical, cardiac surgery and neurosurgery care activities

Abstract
The two decrees of December 29, 2022 mention, for the first time, the term “pediatric surgery” in a regulatory text.
An indisputably recognized specialty in certain fields (neonatology, surgery of malformations), it is too often reduced in other cases to “general child surgery” not justifying specialization.
In fact, in these texts, pediatric surgery is not designated as a specialty, but as a “modality” of care activity.
If only pediatric surgeons are authorized to operate on children under three years of age, adult surgeons may, by way of derogation, in the context of an emergency, operate on other children, subject to having received initial training in pediatric surgery, to have “experience” and to belong to a pediatric surgery DSR.
The organization and operation of DSR thus plays a determining role, controlling skills and training, technical platforms, operating conditions, so that this care meets the expected quality and safety requirements.
