Medical accident rate and litigation: the expert point of view

Abstract

Accident rate: Branchet 2010-2022 data; 219 surgeons sued by 259 patients after an average 3,3 year period. Frequency is a function of overspecialization. Aseptic loosening represents 23% of revision causes and complications occur in 54% of cases. Revision cause or complication, SSI affect 52% of files.
The expert will appreciate: 1/ honest Information, in particular about SSI and neurologic risks; 2/ informed consent; 3/ complete chart, infection risk factors and infectiology advice. He will reproach: 1/ missing information; 2/ lack of traced documents: consent, infectiology advices; 3/ insubstantial surgical preparation; 4/ time lost in complications management (abandonment, procrastination, inappropriate prescriptions); 5/ obstination, solo working, above all in case of SSI, no infectiology or CRIOA solicitation.
