Medical diagnosis during judicial expertise: of expert ’s over clinical knowledge or poor physician’s diagnosis ability ?

Abstract
Medical diagnosis during judicial expertise occurs and raises many questions.
The first one is the implicated physician’s diagnosis ability, which could be related to his patient’s rare disease. Logically, it asks physician’s working ability to search for a more competent colleague, and to ask him his/her advice
The second one is the absence of clinical response to his patient’s disease or difficulty, whatever the main clinical expression is.
Finally, it raises the question of patient’s harm, from sequellaes to death.
We will try to suggest prevention strategy for this occurence base on taking patient's medical history, about two personnal past judicial expertises, any physician, even surgeons, being able face this clinical condition.
