Abstract
Les éléments présentés traduisent le risque médical observé dans les établissements de santé publics et privés assurés par Sham-Groupe Relyens en 2019. Les données de 2020 reflètent une situation exceptionnelle pour tous les acteurs de la santé et ne peuvent servir de référence. Principal constat, la fréquence des réclamations indemnitaires est en constante augmentation mais semble stagner depuis 2019. En revanche, le coût moyen des dossiers augmente, du fait de décisions de plus en plus sévères des magistrats comme de l’augmentation du nombre des condamnations judiciaires et des montants alloués. Enfin, l’impact de la tierce personne est majeur dans les postes de préjudices indemnisables, en lien avec la tendance des tribunaux aidés par les avocats de victimes à favoriser le confort des victimes. Les enjeux d’équilibre de l’activité assurantielle en responsabilité médicale confirment la démarche du Groupe Relyens d’accompagner l’ensemble des acteurs de la santé au plus près de leur pratique afin de comprendre les déterminants de ‘ensemble de la chaîne du soin et de limiter la survenue et les conséquences des accidents.

The data for 2020 reflect an exceptional situation for all healthcare players and cannot be used as a reference. The main finding is that the frequency of compensation claims is constantly increasing but seems to have stagnated since 2019. On the other hand, the average cost of cases is increasing, due to increasingly severe decisions by judges as well as the increase in the number of court sentences and the amounts awarded. Finally, the impact of the human assistance is major in the items of compensable losses, in connection with the tendency of the courts, assisted by victims' lawyers, to favour the comfort of victims. The challenges of balancing the medical liability insurance business confirm the approach of the Relyens Group to accompany all health care professionals as closely as possible to their practice in order to understand the determinants of the entire care chain and to limit the occurrence and consequences of accidents.
