Abstract

The authors report the case of a young 13 years-old girl who presented a polytraumatism having required kidney transplantation. The highest Supreme Court of Justice asked following after a first medical expertise for the application of the Dintilhac’s protocol so that a college of three experts can estimate all the elements of the undergone damage. The procedures of medical expertise required in every case but even more in the complex cases of two principles : that of the strict realization for the legal procedure by answering up to that including but totally the questions of the granted mission and that of the respect for the acquired data of medical science in all the specialties involved in the realization of the damage .The application of the Dinthilhac’s protocol includes more than 20 items which answer the objective of evaluation of the physical and psychological damage; Dintilhac’s protocol is now dedicated by the Supreme Court of justice in the reported observation and its application would have been to avoid entailing the victim in a medical judicial process which lasted more than twenty years.
La réparation du dommage corporel nécessite la réalisation d’un processus d’expertise qui peut revêtir la forme juridique d’un accord amiable, d’un arbitrage ou d’une expertise judiciaire. L’expertise judiciaire est définie dans sa forme par les articles 263 à 284 du nouveau code de procédure civile .Ce travail a pour but l’analyse d’un cas de réparation complexe de préjudice corporel et de décrire les éléments constitutifs d’une procédure médico-judiciaire qui a duré plus de vingt ans.
